Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Fortress Options mobile application and website (collectively, the "Service") operated by Fortress Options ("we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Fortress Options is an educational and informational mobile application that surfaces high-probability options trade ideas ("signals") based on proprietary scoring algorithms applied to publicly available market data. Signals are delivered via push notification and the in-app feed.

Fortress Options is not a registered investment adviser, broker-dealer, or financial institution. Nothing on the Service constitutes financial advice, a solicitation, or a recommendation to buy or sell any security or derivative instrument. Use the Service for informational and educational purposes only.

2. Eligibility

• You must be at least 18 years of age to use the Service.
• The Service is currently available to U.S. residents only. We make no representation that the Service is appropriate or available in other jurisdictions.
• By creating an account you represent and warrant that you meet these eligibility requirements.

3. Subscriptions & Billing

Access to premium signals requires a paid subscription. Current tiers are:

• Pro — $29 per month
• Elite — $49 per month

Subscriptions are billed monthly through Stripe. Your subscription renews automatically at the end of each billing cycle unless cancelled. You may cancel at any time through the account portal or by emailing support@fortress-options.com.

No refunds for partial months. If you cancel mid-cycle, you will retain access through the end of that billing period; no prorated refund will be issued. We reserve the right to change subscription pricing at any time with at least 14 days' notice.

Free-trial periods, if offered, will be clearly communicated at sign-up. Your card will not be charged until the trial ends.

4. Prohibited Uses

You agree that you will not:

• Redistribute, resell, sublicense, or share your account credentials or signals with any third party.
• Use automated means (bots, scrapers, crawlers) to access or extract data from the Service.
• Reverse-engineer, decompile, or attempt to derive the source code of any algorithm or proprietary component of the Service.
• Use the Service to operate or build a competing signals service.
• Violate any applicable law, regulation, or third-party right in connection with your use of the Service.
• Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure.

Violation of these prohibitions may result in immediate termination of your account without refund.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that signals will be accurate, complete, or profitable. Past performance of any signal or strategy does not guarantee future results. Options trading involves a substantial risk of loss and is not suitable for all investors. You could lose your entire investment.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORTRESS OPTIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

7. Intellectual Property

All content, algorithms, branding, and software comprising the Service are the exclusive property of Fortress Options and are protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access the Service for personal, non-commercial use only.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by cancelling your subscription and contacting us. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 9, and 10 survive termination.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

You agree to bring any claim within one (1) year after the claim arises; claims brought after that period are permanently barred.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, notify you by email or in-app alert. Continued use of the Service after the updated Terms take effect constitutes your acceptance of the new Terms.
